OLIVINA PARK HOUSE RENTAL REGULATIONS
§1
These Regulations (hereinafter referred to as the "Regulations") set forth the terms and conditions of short-term rental of fully equipped houses located at Olivina Park in Niechorze (hereinafter: the "facility"), as well as the conditions for making house reservations.
Definitions:
OPERATOR: Amber Park Spa Sp. z o.o., headquartered at Zaciszna 8, Niechorze, registered in the central business registry, NIP: 8571937419, REGON: 526242374, represented by Karolina Krzywańska.
CLIENT: a natural person or legal entity using the house under a short-term rental agreement;
SHORT-TERM RENTAL: a short-term lease agreement as understood under the Civil Code of April 23, 1964, to which the provisions of the Act of June 21, 2001, on tenant rights protection, municipal housing resources, and amendments to the Civil Code do not apply;
CLIENT GUARDIAN: a representative of the Operator authorized to perform actions on behalf of and for the Operator as specified in the Regulations;
PARTIES: jointly the Client and the Operator;
DEPOSIT: a payment made by the Client, equivalent to 30% of the rental fee, serving as security for the preparation costs of the house, which is non-refundable.

These Regulations define the rules for short-term house rental according to the service specification contained in the Olivina Park offer regarding short-term house rentals, available among others via online services. The scope of services covered by the agreement, to which the Operator is obligated, includes the short-term rental of the house with its equipment and any services ordered from the Client Guardian and paid for on site.
§3
The Client makes a house reservation by:
completing a booking form available via the Operator's or its contractors’ websites, unless the booking is made by phone or in person;
sending a completed form containing complete data, including additional services, via email, or placing an order by phone, mail, fax, in person at the Operator’s headquarters, or through the Client Guardian;
receiving confirmation from the Operator (via email) of the house reservation date, number of persons entitled to stay in the house during the reserved period, and the scope of additional services;
making a deposit payment of 30% of the total rental price to the bank account specified in the email within the deadline stated therein and paying the remaining balance no later than 48 hours before the stay. The deposit is non-refundable in case of cancellation or modification.
Making a reservation and paying the deposit constitutes confirmation that the Client has read and accepted the terms of the Regulations.
The reservation is considered made once the Operator's bank account is credited with the deposit amount.
The Client receives confirmation of reservation acceptance via email within 24 hours of receipt of the booking form or order.
By choosing to stay at Olivina Park houses, I acknowledge being informed about the current situation in Poland and applicable restrictions and regulations related to short-term rental.
The deposit or full payment must be made within 48 hours of receiving the Operator’s confirmation of reservation acceptance.
Upon making the reservation and deposit payment, the reservation is confirmed, and the Client will receive an email confirming the deposit payment and further necessary information.
Failure to pay the deposit or full amount within the deadline results in reservation cancellation and notification to the Client.
In exceptional cases, the Operator allows reservations to be made differently, after prior telephone consultation and written or electronic consent of the Client, otherwise null and void.
§4
Reservation changes may involve changing the house or the reservation date, subject to availability.
Changes are only possible after full payment of the originally booked stay.
The Operator reserves the right to cancel or change reservations due to unforeseen circumstances preventing fulfillment (e.g., heating failure, power outage). With Client consent, a new date or house is assigned and deposit applied; otherwise, deposit is refunded.
If changes are made due to unforeseen circumstances, no additional costs apply to the Client.
§5
House handover on the first rental day is no earlier than 16:00 unless agreed otherwise.
The Client must inform the Client Guardian of the expected arrival time at least 4 hours prior unless agreed otherwise and must immediately notify of delays. The Operator is not liable for delays caused by lack of timely notification.
The house is handed over upon presenting a valid photo ID to the Client Guardian and handing over the keys. The Client Guardian will demonstrate the house equipment upon request.
The “Usage Regulations” attached via email with the reservation confirmation govern the Client’s use of the house and its equipment.
House handover is conditional on full payment of the rental fee minus the deposit.
Rent payment is based on an invoice provided electronically or in writing.
Upon receiving the keys, the Client must sign a registration card, confirming acceptance of the rental terms and the Regulations.
The Client Guardian may refuse key handover to intoxicated, aggressive persons, or those suspected of violating the Regulations or laws, or refusing to accept the invoice or sign the rental agreement.
The Client must immediately report any damages found in the house to the Client Guardian.
Damage must be reported within one hour of house handover.
The Client is liable for damages caused by themselves or their guests, especially due to misuse.
The Operator is not responsible for the Client’s or guests’ belongings left in the house or parking during or after rental.
§6
The number of persons allowed in the house is limited to that specified in the confirmed reservation.
Pets may stay in the house for an additional fee per the current price list.
Smoking and open flames are prohibited. If deodorization is required due to smoking, a fee of PLN 1000 applies.
Quiet hours are from 22:00 to 07:00.
Subleasing or transferring the house to third parties is prohibited.
No repairs or modifications may be made without written consent of the Operator. Any required repairs must be reported immediately.
The Client must maintain and return the house in the condition it was received.
The Client must report all damages caused during the stay and covers repair costs. They are responsible for damages by guests allowed by them.
The Client Guardian has the right to enter the house to fix issues or investigate suspected violations.
If the Client is absent during such entry, the Client Guardian will inform the Client immediately.
The house must be returned by 11:00 on the last rental day; late return requires prior Operator consent.
Keys are returned to the Client Guardian upon rental termination, unless otherwise agreed.
Failure to return the house on time results in a contractual penalty of twice the current daily rental price per day.

Rental price includes utilities:
electricity
water
gas
sewage disposal
garbage removal
internet access (if available)
cable TV access fees
Upon key handover, the Client must pay a local tax (“climatic fee”) to the Client Guardian.
Unused services paid for by the Client, where the Operator was ready to provide them (including early departure), do not entitle the Client to claims.

Correspondence may also be sent to Amber Park Spa – Olivina Park, Zaciszna 8, 72-350 Niechorze.
Polish law governs disputes between the Client and the Operator.
Disputes will be resolved by the court competent for the Operator’s registered office.
The Operator reserves the right to amend these Regulations at any time, effective upon publication on www.olivinapark.pl.
Changes do not apply to contracts concluded prior to amendment; those contracts are governed by the Regulations in force at their conclusion.
TERMS AND CONDITIONS FOR STAYING IN OLIVINA PARK HOUSES
Upon key handover, the Client Caretaker (upon the Client's request) explains how to operate selected electrical devices that are part of the house equipment.
Upon receiving the keys, the Client is obliged to check the technical condition and inventory of the house and its equipment.
The Client is responsible for the door access cards. In case of loss, a fee of 50 PLN per card will be charged.
Failure to report any comments or objections regarding the technical condition of the house at check-in is equivalent to accepting the house in good condition, fit for the intended use.
Due to fire safety regulations, it is strictly forbidden to use any electrical or gas-powered devices not provided as part of the house equipment (especially electric heaters, space heaters, gas burners). Burning candles inside the house is also prohibited.
It is forbidden to bring into the house any flammable, explosive, irritating, or foul-smelling substances, or any intoxicants.
It is not allowed to dispose of solid household waste, solid objects, garbage, newspapers, or wastewater above 60°C into the sewage system. Chemicals not intended for such use must not be poured into the system. Ventilation openings must not be blocked.
All technical equipment must be used according to its intended purpose and technical specifications.
Failure by the Client to use any ordered and paid services, which the Operator was ready to provide (including early departure), does not entitle the Client to any compensation or refund.
Pets are allowed in the house only with the prior consent of the Client Caretaker and upon payment of an additional daily fee in accordance with the current price list.
The Client and persons staying in the house with their knowledge and consent are obliged to care for the rented house, switch off unnecessary lights, turn off water, supervise all operating devices, and switch off devices after use.
It is strictly forbidden to remove from the house any items belonging to the property (especially towels, blankets, pillows, furniture, equipment, etc.).
Every time the Client leaves the house, they are obliged to ensure that it is securely locked.
The Client is fully responsible for any damage to the Operator’s property, as specified in the Olivina Park Rental Terms and Conditions.
On the departure day, the Client is obliged to provide access to the house for the Client Caretaker to check its condition. The Client may leave only after the inspection is completed.
Smoking is strictly prohibited inside the houses. Smoking is only allowed in designated outdoor areas.
The Operator may refuse to provide further services to any person violating the no-smoking policy. In such a case, no refund will be granted.
If smoking is detected in the house, the Client will be charged a 1000 PLN deodorization fee.
As a deposit against potential damages, the Client is required to pay a security deposit of 1000 PLN in cash or by card at check-in. The deposit will be refunded within 48 hours after check-out if no damage is found.
The Client is obliged to maintain and return the house in the same condition in which it was received.
The Operator is not responsible for any belongings left behind in the house.
If, after the end of the rental period, the Client Caretaker finds personal belongings left by the Client, they may (upon the Client's request) be returned at the Client’s expense to the address provided. If no request is made or items are not collected within 2 days after the rental agreement ends, the items will be disposed of.
The Operator is not responsible for any inconvenience during the stay caused by construction, finishing, or renovation works in or near the house, noise, or utility service interruptions.
The Operator reserves the right to perform maintenance on devices and facilities at any time, including during the Client’s stay.
In the event of violation of the regulations, the Operator may refuse to provide services to the person responsible. Such a person is obliged to immediately comply with the facility’s requests, settle any outstanding payments, pay for any damage caused, and leave the premises.
Buffet Usage
Entry to the buffet area and consumption of the ordered meal is permitted once per day.
Re-entry and consumption after leaving the buffet area are not allowed.
The staff reserves the right to monitor compliance with the buffet rules.
